1.20 Ticking noise from vents while furnace is off?

Q. I've had rats which after 2 months of pest control they should be history. I've sealed everything off around my mobile home completely. Now, I hear this ticking sound by the vents in the floor and the furnace is always off. I keep my home on the cool side-only use it in the morning for a few minutes. I am paranoid about rats and thought they might be in the duct/vents.Terrible damage done from rats. I had a duct/vent cleaning company come out-they say they get all mice, birds and rats etc. from the ducts. However, I still hear the noise-seems to be in the morning from about 9 to 10am and at night between 8 and 10pm. I had a contractor go under the mobile home and tie everything up and secure the vents with sheet metal and screws to prevent any movement. Then the noise got worse:loud, thump, tick-tick and bang. I don't know if my water lines go along the ducts/vent lines and could cause this noise? I am not using water at these times,either. My water heater is on the other side of the mobile home-10ft away in a straight line from the bathroom/bedroom wall. The vents on either side of this wall is where I hear the noise. All the water faucets, shower etc are on the opposite side of the house from the water heater. Could the water lines from the water heater (12 yr old water heater) cause this noise running close to the vents? I've done everything I know to do. These sounds have occurred during the past 3 months-since the rat thing. Any suggestions? anyone? please help.

A. I am a person who hears every little noise and must catalog what it is before I can stop concentrating on it. However I still am vary aware of each and every noise that takes place around me. What you are describing in my mind is expansion and contraction of the trailer and heating duct. This is amplified by the barren metal walls with in. Seeing that it got worse when they where secured that it most surely is the case because now not only does the metal have to struggle more in its secure fastening it has to deal with the expansion of the trailer. If the noise gets to where it is irritating you try laying out a heavy peace of cut carpet along the bottom of the duct to collect some of the noise. When I had a rat or mouse problem in another home I used plastic bags to alert me of their presence. I would hear a distinct rustling of the bags.

1.20 Rats or hot water heater noises? puzzled.?

Q. In a mobile home, I hear clicking, ticking noises by the bathroom and bedroom vents-they are adjacent to each other. I had a bad problem with rats-pest control came out for 2 months-caught 2. They had chewed up water lines and the over flow pressure tube from the hot water heater. I had the ducts/vents cleaned out by professionals, in case, some mice were making the noise I still hear by the vents-usually at 9 to 10am and 8-9pm at nite or so. I still hear the tick, tick noise. I had a contractor go under the mobile home and secure the vents with sheet metal and tighten pipes and anything that might rattle-down-now, the noise is even louder-thud, bang and tick, tick. The hot water heater is in a straight line about 10ft on the other side of the mobile home from the bathroom/bedroom. What could be causing this noise? could it be the hot water heater? The water faucets/shower are on the opposite side of the house from the hot water heater-its 12 yrs old,now and I have very hard water. Would a plumber be the one to call? Please help me. I've sealed all around my mobile home against rodents, plugged all holes and pulled all insulation out, secured everything-still here that noise. I still hear the noise about 10ft from where the hot water heater,near the bathroom/bedroom vents. Either its 'evil spirits', water heater making noises in the water lines? I've spent thousands trying to get back to 'normal'-from the rat damage etc. and I don't want to replace the hot water heater if I don't have to-but, I will-just to get some peace-if that's what the noise is coming from. Help! I've had a very bad time. What do you think it might be, please?

A. It sounds like the expansion and contraction of the pipes and heating duct surfaces. You really need to relax. I live in an old house and it makes all kinds of noises. Try putting on the tv or a mellow radio station or a fan as white noise and don't worry about the normal noises of living.If you see a rodent then that is one thing but don't freak about stuff that's not that big of a deal. Relax.

1.20 What is the law reguarding one year contracts for pest services in FL?

Q. I have heard that you can break a contract any time you want with pest control but the company I went with insists that I have to sign a contract. Any one know the legalities of this?

1.20 How can i be a crime-scene cleaner?

Q. Im 18 & would be interested in being a cleaner that deals with bio-hazards, e.g pest control, crime scene's, Hypodermic needle collection . I know it's gross but i think it would be interesting & i hear these kind of cleaners get paid alot! How can i get trained, do you have to have experience as a cleaner or can anyone do it? What happens after i am trained & get a licence to deal with bio-hazards, do i have to be employed by a cleaning company? (im from the UK)

A. You'd be better asking your local police who they employ for this kind of service Can't imagine it being a full time job though, as many murders happen out of the home and therefore little clean up is required compared to crime scenes indoors

1.20 Help!!!!!!!!! drain flies?

Q. Hi everyone, need a bit of help. got a problem with my drains at the mo, keep blocking from time to time. now i am waiting on dyno rod to come out and do there bit on it in the next 2 weeks. but over the last 3-4 days i have been infested by drain flies (about 100 on the patio dorr today when i came home) i used some industrial drain cleaner to see if it made it better but guess i'll have to wait and see. once dyno rod have been will they go away????? or is it a job for pest control???

A. I would say pour bleach or vineagar down the drain and plug the drain tight. BUT..... You have been using drain cleaner you MUST be careful about mixing chemicals so be careful what you pour down the drain. But plugging the drains will help alot.

1.20 What can I do if one of my tenants has there apartment filthy and piles of debris and clothing everywhere?

Q. The main thing is we were in her unit for something else and happened to notice she had roaches I freaked and called the pest control. i sent her a notice that he was coming to do all 6 units in her building at once and left complete instructions on what she needed to do including clean up the debris but, she didn't do it. Since then he has come again to find the place a disgusting fire hazard with dead bug lying every where. He had to climb over a bike and piles of debris to get in the kitchen the rest of the place was pretty much like that as well. That has got to be a safety issue and fire hazard not to mention the company wont guarantee the service because her unit is so disgusting so we have had to pay 2 times already and working on a 3rd in a week. What can I do? I wouldn't live with bugs so I sure wouldn't expect my tenants too.

A. Your Real property is a business, no different then your local supermarket; your product is Habitable housing. You are also bond by state tenant laws, city codes/laws which applies to both the LL & tenant. First, the easiest think that you could have done is give a 3 day notice to quit; they are not just for late rent. The 3 day notice is to correct/comply with an issue that falls under tenant responsibilities. Next, is to give a 30 day notice to vacate; because she would at that point willfully not complied and now you have incurred costs. You can still do this. Next, the pest company was under no obligation to go into the unit and was actually in your best interest if they didn't; he should have documented on his assessment of the unit that he did not want to enter the unit for the reasons you mentioned. This is your paper trail for compliance, and something you would need to make her paid for additional cost incurred by your business. Now, funny that you mentioned safety & fire hazard issues; this could turn on you for the same reasons you are concerned about the dirty tenant; either by that tenant or other tenants can now claim Habitability issues because of pest; if your all tenant's have children and take that a child to a doctor, and that doctor declares that the pest have infected that child guess who is liable - not the dirty tenant.... So, long advice longer - document, document, document...take picture of the unit, let the tenant know you will be deducting the cost from her security deposit; you may have to consult an attorney on how your state handles depleted security deposits - different rules per state. He may suggest that you give the tenant the entire bill in lew of the security deposit.

1.20 Texas Property code regarding security deposits?

Q. Please be patient this is a pretty detailed list of reasons and details following my move out. I recieved a notice to vacate in December due to my landlord wanting to move back into the residence to save money. My lease was up on Feb 2, 2011 but due to my landlord having surgery (implants)she asked if I moved out a week or two early she would pro-rate the rent. I surrendered my keys to her on January 26, 2011 which she would owe me for 5 days of rent which she said she would return to me with my security deposit. She then picked up the keys at my new residence only 4 houses down from my old one (the one she currently resides in). After several text messages and phone calls she failed to let me know about the deposit. I recieved a certified letter postmarked March 4, 2011 with a list of deductions from the deposit plus an additional 777.41 on top of that. Here is the list with some explanations. A/C coil/blower cleaning $350.00 She states due to dirty air filters. We changed them once a month and the outside unit went out 7/09 and she did not get the inside serviced she only had the outside unit installed with a used unit that cost her $300.00. Junk Hauling $200.00 This is due to a new privacy fence the neighbor put up without any money from the LL he bought all wood himself and my husband helped with the labor, but he left all wood in our yard stating since she did not help out money wise with the fence she could haul it away but now she is charging us for that. I felt this was an issue between them two. Hole in backyard $ 175.00 The phone company was putting in new lines and dug a hole in the yard but did not come to fill it or finish the work. I did not have service with AT&T I had Time Warner so I feel that is definantly not my responsibility. She states she called and they have no records of this. Back Yard Mowing $150 Due to the large hole and the fence it was hard to weed eat around it and due to a rainy January we did not cut the grass in the back so I feel I should be held responsible for that. Exterminator $427.09 She had an exterminator come out and perform pest control and she recieved a years service and took that out of my deposit. I can understand being charged for a month but a whole year come on? Painting $200.00 Upon move in the house was painted crazy with one blue wall and the rest white but with dirty hand prints everywhere and she gave us permission to paint it so we painted it dark brown to cover the dirt and because it matched our furniture. Which made the house look quite nice. Also we put in flooring in the kitchen at our own expense to make the house look nice which we understood this was something we would not be getting credit of we did that on our own. We just like our house to look nice and presentable for our guests. Hole behind bedroom door $30.00 There was no door stop so this caused a small hole where knob hit the wall. This I agreed to pay. Hole in Fireplace $30.00 I am not sure how that happened but agreed to pay that as well. Now from what I researched under the Texas Property code if the landlord does not either return security deposit or itemized deductions they are acting in bad faith and cannot charge for damages and must return the security deposit. I am not saying I won't pay for any fees for some of the mess because I will but I feel she is taking it to the extreme and just does not want to give it back to me. Let me also include that she picked up the keys on 1-26-11 and the next day they converted the garage into a bedroom and the trash she had hauled from the back also included the trash she had from the garage and from her move in on 1-28-11. I saw the invoice from the haul/lawn company and it was dated 2-11-11 and I have neighbors confirming this. As far as the charges she only paid for the extermination and the holes in the walls but just got bids on the others. Can she do this to me? Are these acceptable fees? Should I be charged for each one? I am just a little upset she always said how nice we made her house look and made all repairs except for a/c on our own paid on time in fact almost a week early everytime. It seems her breast implant cost her to much and now she has bids but no actual receipts to return at least my pro-rated rent or a portion of the deposit. So I am very upset and am thinking of consulting an attorney but not sure if I would even have a chance. Help! I need some advice. Should I just swallow the bitter pill and pay these crazy fees??

A. Lets look at the questionable ones you listed. First, Texas Security Deposits are covered under the Texas Property Code, §92.101 - §92.109, protecting the rights of renters regarding their security deposit. According to Texas law, the landlord has 30 days to return the deposit or give an itemized list of deductions. Jan 26th to March 4th is greater than 30 days. !) The A/C, if she can prove that the dirty air filters led to the problem, then you will have to pay, if you go to court, you may get the judge to reduce the cost, or ignore it if the repairs have not been made. 2) Junk hauling, in court, if you can prove that the amount included her trash as well as yours, again, the amount may be reduced, this one is tricky, you can't just ignore it and assume that 'they will sort it out between them'. 3) hole in the backyard, again, if the work was done while you were living there, then it was your responsibility to make sure it was completed, you need to call AT&T and follow up on that one yourself. 4) Painting, this should be in your lease, assuming you were there for a year, then you are not responsible for repainting, that said, if you painted the walls a different color (brown) then the landlord can charge you for repainting to a 'normal' color, off white or eggshell. 5) Exterminator, unless your lease states that you will pay for extermination to the property when you leave, she can't charge you for it. She certainly can't bill you for a years service contract. Do I think you have a case? Absolutely. I think you need to file in small claims court, start with requesting the entire deposit back, if you can prove that she acted in bad faith, you can collect 3 times your security deposit back. If the total you are seeking is 5000.00 or less, small claims court is the avenue to take. If I were your landlord, I would negotiate your fees down to no less than the hole in the fireplace, the hole in the wall, painting, backyard mowing, 1/4 the cost of the junk hauling (assuming you can prove that they also hauled her trash) and half of the A/C repair (less if you can prove that you religiously changed the filter). for a total of 635.00. Start with an attempt at negotiating, then send a registered letter disputing the claims, then file a suit.

1.20 What to put in walls to keep spiders out of house?

Q. I recently had a flood in my house. The restoration company tore everything out, including 2 feet of drywall from the floor up. My whole downstairs is exposed (I can see studs, etc.) Soon they will be patching everything up, but before they do I was wondering if there was anything I could put at the base of the wall to help with spider control. We have so many spiders in our house and this could be a good opportunity to put a barrier down in the walls to help deter them.
